Like a finance audit, an HR audit is an independent and objective evaluation of the current state of an organisation's HR policies, practices, documentation, and systems.

An HR audit can alert a company about hidden HR-related problems and errors, as well as possible compliance issues against a backdrop of China's ever-evolving rules and regulations. This can allow an organisation to establish best practices, thereby protecting it against possible operational and legal risk.

This event is with two parts. In the first part on HR Audit, you will hear from the speakers:

  • Why doing HR compliance audit is necessary? (case study included)
  • How does an HR compliance audit? What do we need to audit? (e.g. labour contract, employee handbook, HR internal process)
  • Which law or regulation do we need to rely on when facing audit problems?
  • How should we deal with audit problems? (e.g. employee handbook confirmation letter, over time policy and record)

Recruitment is not just a simple 'matching game' to choose the right candidates. However, lots of companies didn’t recognise legal risks during hiring procedure, and some of the common practices are not appropriate or compliant with local labour laws, which may bring risks to the company.

In the second part on Recruitment Risk Avoidance, the follwong will be discussed:

  • What are the potential risks during recruitment procedure?
  • How can we avoid and protect our company from these risks?

Speaker Introduction

Ellen Yin

Assistant Manager, Human Resources, Dezan Shira & Associates

Ellen Yin currently works as the Assitant Manager on the HR & Payroll Services team of Dezan Shira & Associates' Shanghai office. She advises clients on employee relationships, C&B recruitment, training, salary structure, and performance appraisal. With over several years of experience in Human Resources and Payroll Management, Ellen is familiar with China labor regulation and is able to help clients identify risks and weaknesses through HR Audit work.

Before joining Dezan Shira, Ellen has served multiple positions at several big enterprises and SMEs. Ellen has a Master's degree in Business Administration from Zhejiang Normal University and a Bachelor's degree in Human Resource Management from Hunan Technology University. She also holds the level one China Human Resources Certificate.

Allan Xu

Manager, Business Advisory Services, Dezan Shira & Associates

Allan Xu is a manager on the Business Advisory Service team at Dezan Shira & Associates' Shanghai office. She provides legal advisory on FDI investment vehicle, investment structure, deal structure, capital structure, incorporation, daily operation, mergers & acquisitions, restructuring, liquidation, contract drafting and review, intellectual property protection, trademark registration, labor law, labor arbitration, work permits and residence permits for expatriates. She is also familiar with incorporation of different types of Singaporean entities such as private limited companies, branches and representative offices etc.

Prior to joining Dezan Shira & Associates, Allan worked as an arbitrator in a district Arbitration Institute in Shanghai from 2007 to 2013, then joining a multinational consulting firm providing legal advisory services and corporate secretarial services to foreign investors. In 2013 and 2014, she worked in Singapore for 7 months to assist Chinese investors doing business in Singapore.

With more than 8 years of legal practice, Allan is experienced in incorporation, corporate compliance, mergers and acquisitions, restructuring, legal due diligence, project investment, international trade, offshore investment, intellectual property, labor law, contract review and drafting, dispute settlement, arbitration and litigation. She has dealt with more than 2,000 labor arbitration cases as a labor arbitrator.

Allan has a degree in Law from East China University of Political Science and Law, and also holds the Certificate of Lawyer’s Qualification.
